KREASI Morotai is pushing forward the Draft Regent Regulation (Peraturan Bupati/Perbup) on Child-Friendly Regency (Kabupaten Layak Anak/KLA), which has gone through public consultation and was submitted to the Regional Office of the Ministry of Law (Kemenkum) Maluku Utara for e-harmonisation on Friday (17 October 2025).
This policy is expected to protect and safeguard children’s rights, as well as serve as guidance for all relevant stakeholders on what may and may not be done in relation to children.
In the e-harmonisation process, KREASI emphasised that child protection is not only the responsibility of the Office of Social Affairs, Women’s Empowerment, and Child Protection, but a shared effort involving multiple actors. This approach is also important for building a clear legal framework so that child protection can be effectively implemented at the regency level.
The policy serves as a guideline for implementing child protection efforts in an integrated way across different levels, while at the same time accelerating the work of UPTD PPA with adequate operational support. KREASI Morotai aims for this Regent Regulation to come into effect within this year as a concrete step to strengthen child protection in the region.
Based on the results of the e-harmonisation, the Ministry of Law and Human Rights stated that the draft Regent Regulation must take into account the provisions of Presidential Regulation Number 25 of 2021 on Child-Friendly Regency/City Policy. Article 8 paragraph (3) of this Presidential Regulation delegates the implementation of KLA to be regulated through a Regional Regulation (Peraturan Daerah/Perda), not a head-of-region regulation (Peraturan Kepala Daerah/Perbup). This principle follows the norms for the formation of laws and regulations, namely the alignment between type, hierarchy, and substance. Therefore, further regulation based on the delegation in Article 8 paragraph (3) needs to be set out in a Regional Regulation in order to comply with the prevailing legal hierarchy.
“We appreciate it if the Ministry of Law considers that this draft is more appropriate to be elevated to the level of Regional Regulation. The support of the local government and the DPRD is very important so this process can run smoothly. We invite the DPRD to take steps to upgrade the draft Regent Regulation into a Regional Regulation, while the limited discussions with the Head of the Office of Social Affairs and Women’s Empowerment and Child Protection are ready to be continued at the Perda stage,” said Program Manager of Stimulant Institute, Yeni.
Through these steps, KREASI Morotai hopes that the Child-Friendly Regency can soon be realised, providing clear guidance for child protection and supporting the fulfilment of children’s rights effectively at the regency level.
