KREASI Morotai Advocacy Produces Draft Literacy and Numeracy Regent Regulation to Be Upgraded into Regional Regulation 

KREASI Morotai is collaborating with the Government of Kabupaten Pulau Morotai to strengthen literacy and numeracy. This effort has resulted in a draft Regent Regulation (Peraturan Bupati/Perbup) which has gone through a public consultation process and was submitted to the Regional Office of the Ministry of Law (Kemenkum) Maluku Utara for e-harmonisation on Thursday (16/10/2025). 

In the e-harmonisation process, Kemenkum stated that there are still several provisions in the draft Perbup that need to be aligned, both in terms of the technical aspects of regulatory drafting and the substance of its content. One of the points that needs adjustment is the formulation of norms that impose obligations without being accompanied by provisions on sanctions. 

The weighting of the substance in this regional regulation can also be strengthened by adding provisions on implementing actors and the roles of stakeholders. This is to be aligned with the 2017 Literacy Movement Guideline of the Ministry of Education and Culture, as well as provisions regulating the granting of awards to motivate organisers of literacy activities. 

“This draft regulation is very important and beneficial, so in my view it needs to be enacted immediately,” said Dean of FKIP Universitas Pasifik, Fahmi Djaguna. 

One of the outcomes of the e-harmonisation process is the conclusion that the draft Regent Regulation (Perbup) on literacy and numeracy needs to be elevated into a Regional Regulation (Peraturan Daerah/Perda). This stipulation is based on the provisions of Minister of Home Affairs Regulation Number 120 of 2018 which amends Article 42 paragraph (1) of Minister of Home Affairs Regulation Number 80 of 2015 on the Formation of Regional Legal Products, which states that “Head-of-region regulations (Perkada) are stipulated by mandate of higher-level legislation or based on delegated authority.” 

Up to now, Kabupaten Pulau Morotai has not had a Perda that regulates literacy and numeracy in the context of the implementation of governmental affairs and co-administration tasks. Therefore, this draft Perbup is considered more appropriate to be regulated through a Regional Regulation.
